The terms and conditions set out below (the “General Terms and Conditions”) govern access to and use of each and every web page located under the domain “Jeanologia.com”, and its respective subdomains and subdirectories (the “Website”), owned by Jeanologia S.L., a commercial company with registered office at Edificio Jeanologia, Ronda Guglielmo Marconi 12, P. Tecnologico Paterna Valencia, incorporated for an indefinite period by virtue of a public deed and registered in the Commercial Registry of the province of Valencia in Volume 5151 of the Archive, General Section, Folio 147, Sheet no. V-40409 and with Tax ID no. B96381249.

Access to the Website and the use of its contents and services implies full and unreserved acceptance of the General Terms and Conditions set out in the version published at the time the user accesses it. The latest version of the General Terms and Conditions may be consulted whenever desired at the electronic address www.jeanologia.com.

If the user decides not to accept the current Terms and Conditions, they must refrain from accessing the Website and/or using the contents and/or services available therein.

Purpose of the terms and conditions

The purpose of these Terms and Conditions is to regulate access to and use of the Website. For the purposes of these General Terms and Conditions, the Website shall be understood as:

  • The external appearance, or “look and feel”, of the screen interfaces, both statically and dynamically, that is, the navigation tree.

The user acknowledges and accepts that Jeanologia may at any time interrupt, deactivate and/or cancel any of the Contents and/or Services included on the Website.

Specific terms and conditions

Access to and use of certain Contents and/or Services may be subject to certain specific terms, legal notices, guidelines and rules of use which, having previously been made known to the user, and depending on the case, shall replace, complete and/or modify the General Terms and Conditions set out herein, hereinafter the “Specific Terms and Conditions”.

Access to and use of such Contents and/or Services shall therefore imply full acceptance of the specific terms and conditions governing them in the version published at the time the user accesses them, and such Specific Terms and Conditions shall be automatically incorporated into these General Terms and Conditions.

In the event of a contradiction between the terms and conditions set out in the General Terms and Conditions and the Specific Terms and Conditions, the terms agreed in the latter instrument shall always and in any case prevail with respect to those incompatible terms and only with respect to those Contents and/or Services subject to such specific regulation.

Access to contents and services

The user may not choose as a username or password words and/or expressions that, in general, are contrary to the law or to generally accepted morality and good customs and, in general, words and/or expressions over which any right exists that excludes their use by the user.

To this end, the user may not select words or expressions that are offensive, insulting, slanderous, identical, similar or in any way coinciding with distinctive signs, company names, as well as names, surnames, artistic names and/or pseudonyms of third parties.

If the user provides any false, inaccurate or incomplete data, or if Jeanologia has sufficient grounds to suspect that such information is false, inaccurate or incomplete, or is contrary to the law or to generally accepted morality and good customs, in accordance with the provisions of the previous paragraph, Jeanologia shall have the right to cancel the registration and deny present or future access to and use of the Website or any of the Contents and/or Services incorporated therein.

The user undertakes to use their username and password diligently, as well as to keep both secret. It shall be the exclusive responsibility of the user to maintain the confidentiality of their username and password, personally assuming any activities carried out or taking place through their use.

The user may cancel and deactivate their registration at any time using their username and password. The user acknowledges and accepts that Jeanologia reserves the right to cancel registrations that remain inactive for a period of time that is not reasonable.

Rules for use of the site

The user undertakes to use the Website and the Contents and/or Services incorporated therein diligently and correctly. Likewise, the user undertakes not to use the Website:

  • For unlawful, prohibited purposes or effects, or purposes or effects harmful to the rights and interests of third parties, with Jeanologia declining any liability that may arise from all of the above.

Force majeure

Without prejudice to the foregoing, Jeanologia shall not be liable for delays or failures occurring in the access, operation and functioning of the Website, its Contents and/or Services, nor for interruptions, suspensions or malfunctioning thereof, when these originate from breakdowns caused by natural disasters such as earthquakes, floods, lightning or fires, force majeure events, extreme emergency situations such as wars, military operations, civil unrest, strikes, lockouts or any other force majeure event or fortuitous cause.

  • Contact: To respond to questions sent to the company, as well as to handle requests for information about the services and products we offer. The data shall be retained until the user exercises their right of cancellation.
  • Join us: To carry out the company’s internal personnel selection procedures, both current and future. The data shall be retained until the candidate exercises their right of cancellation.
  • Payments: Payment of invoices through the PayPal system. This is an external payment method and is not subject to the responsibility of Jeanología S.L. The data shall be retained by virtue of the legislation applicable under commercial law.

Legal basis for processing your data:

  • Contact: Authorization by the user.
  • Join us: Authorization by the candidate.
  • Payments: Performance of a commercial contract and legal obligation, Royal Legislative Decree 1/2007 of 16 November and other complementary regulations, Commercial Code.

Your data shall not be transferred to any third party, except where required by legal obligations.

JEANOLOGIA adopts technical, administrative and organizational measures in its systems in order to protect personal information, preventing its loss, theft, disclosure, alteration or unauthorized use. JEANOLOGIA reserves the right to investigate any content that violates this Privacy Policy, as well as any incorrect, improper or fraudulent use of the conditions set out.

To use or access certain Services and/or Contents, Jeanologia may require users to complete certain registration forms that necessarily involve the provision of certain personal data. Jeanologia shall process such data in accordance with the purposes and under the conditions detailed in each case.

Intellectual property, industrial property and other rights
Applicable law

This Website, as well as the Contents, Services and elements integrated therein, are owned by or are under the control of Jeanologia, and are protected, without limitation, by the intellectual and industrial property laws of the Kingdom of Spain and by any applicable international Treaties and Conventions.

Ownership of Jeanologia

Jeanologia is the exclusive owner of all intellectual, industrial and analogous property rights that may apply to the Website. Likewise, all rights are reserved in favor of Jeanologia over any Contents, Services or elements owned by it that are incorporated into the Website, including, by way of example and without limitation:

  • Those elements that make up the visual appearance, graphic image and other sensory stimuli of the web pages that form the Website.
  • The navigation architecture.
  • The source codes of the web pages.
  • Photographs.

Jeanologia authorizes users to access and browse the Website, using the Services and viewing the Contents incorporated therein.

Users are not authorized to copy, distribute, including emails and the Internet, transmit, communicate, modify, alter, transform, assign or, in any other way, carry out activities involving the commercial use of the Website, its pages, Contents or elements that comprise it, whether partially or totally, without the express written consent of the legitimate holder of the exploitation rights.

Jeanologia reserves all rights over the Property including, by way of example and without limitation, all intellectual and industrial property rights it holds over them. Jeanologia does not grant the user any other license or authorization of use over its Property other than that expressly detailed in this clause.

Link license

Users and, in general, any persons intending to establish a link between their website and the Website must comply with the following conditions detailed below. Any other linking intention other than that stipulated in this clause shall require the prior written acceptance of Jeanologia.

Termination of licenses

Jeanologia reserves the right to terminate or modify at any time and for any reason the licenses granted under these General Terms and Conditions. Without prejudice to this, Jeanologia may take legal action against any use by the user that:

  • Does not comply with the terms and conditions specified herein.
  • Infringes or violates the intellectual and industrial property rights or other analogous rights of Jeanologia or of any other legitimate third-party holder.
  • Infringes any applicable regulations.

The user shall be obliged to immediately modify or remove from their website any Jeanologia Property, or remove any link to the Website, when required to do so by Jeanologia.

Infringement notification procedure

In the event that any user or third party considers that there are facts or circumstances revealing the unlawful nature of the use of any content and/or service, or of the carrying out of any unlawful activity on the web pages included in the Website, or through the Services provided, they may contact the Legal Department at Jeanologia’s registered office indicated above, providing the following information:

  • The name, surname, national identity document, address, telephone number and email address of the claimant, as well as, where applicable, the signature of the holder of the allegedly infringed rights or, where applicable, of the person authorized to act on their behalf and representation.
  • Identification of the alleged unlawful activity and, in particular, when it involves an alleged violation of intellectual or industrial property rights, a precise and specific description of the protected contents as well as their exact location.
Validity of the general terms and conditions and their modification

The legal relationship arising from access to and use of the Website, as well as of the Contents and Services incorporated therein, has an indefinite duration. Likewise, either party may terminate or suspend this contractual relationship unilaterally at any time and without any cause other than their will to do so.

Without prejudice to the foregoing, such relationship shall be deemed terminated immediately when Jeanologia publishes new General Terms and Conditions. Access to and use of the Website shall imply full acceptance of the new terms and conditions and, consequently, the start of a new legal relationship.

Jeanologia reserves the right to modify these General Terms and Conditions at any time and without prior notice.

Assignment to third parties

The user may not assign, transfer, encumber or subrogate in favor of third parties the rights and obligations established in these General Terms and Conditions and, where applicable, in the Specific Terms and Conditions.

Jeanologia may assign, transfer, encumber or subrogate in favor of third parties, totally or partially, the rights and obligations assumed under the contractual relationship set out herein, as well as the contractual position to any third party, it being understood through this clause that the user grants sufficient authorization for this purpose.

Applicable law and competent jurisdiction

The Website is operated and controlled by Jeanologia from its offices in Spain. Consequently, all matters that may arise from access to and/or use of it shall be understood to be governed and interpreted in accordance with Spanish legislation.

In the event that the user is domiciled outside Spain, Jeanologia and the user submit, expressly waiving any other jurisdiction, to the competent Courts and Tribunals of the Kingdom of Spain.

Notifications

Unless otherwise indicated, all notifications, requests, agreements, consents, acceptances, approvals or communications that may be required in accordance with the provisions of these General Terms and Conditions or that, in one way or another, are related thereto, must be made in writing and sent to Jeanologia by post to the company’s registered office, addressed to the Legal Department.
